My buyer called at the crack of 8:30 this morning to tell me she wants the house and asked me to fax the paperwork over. We finally got everything faxed and signed and off to the title company (she requested that she use her title company if she is paying all of the closing costs, which I couldn't really argue with).

I got another call from her at around 6ish telling me the title company thinks there is a Discover lien attached to the seller's name for $8500, and she needs me to call the seller and get his middle name and social security number to find out for sure. This did not seem right to me, as I thought the title company should be able to get this info rather easily. When I tried (politely) to ask the buyer about it (I will call her Crazy Caroline from this point forward), she got all bent out of shape and started getting REALLY rude with me. I was completely caught off guard by this. No idea what her problem is, but I can tell you, after the day I had today and the one I had yesterday, I was in no mood for putting up with anyone's crap- especially since I have been nothing but nice to this lady up until this point. So, after arguing with her for several minutes, I finally told her I would call the seller and ask him about the lien. This was mostly done just to get her to shut up, and also to get myself off of the phone before I said something I would regret. This lady really pushed some buttons. Particularly the "Well, I guess if that's how you want to run your business.." comment. That, and insinuating that I was trying to kill the deal so I could keep her deposit. Pissed me off.

So anyway, I called the seller and told him what was going on, and suggested that he call the title company himself to see if they could get it straightened out. Next I called CC back to let her know I called him. I haven't heard back from either one of them since. I did, however, check the county clerk's website, and found the lien that the title co was talking about (no idea how I missed it the first time), and- it is his. I don't know why it was so hard for them to figure it out. The document is right there, plain as day, with the seller's name and address on the judgement. This shouldn't affect the deal, I don't think. He will not be getting as much money at closing, but he won't have to bring cash to the table or anything. Unless, of course, there is another lien lurking somewhere in the shadows.

I certainly hope this is the last I hear from CC until closing day.

hey steph, its serena. been reading your blogs. dont feel alone its hard times for a lot of people including me. anyway, i think that the credit card judgment will stick. from prior experience i had a situation just like that and it killed my deal. best thing is to see if you can negotiate the cc debt down

Hi Serena,

I don't think it will have any affect on the deal. The seller will just get less money at closing. His tenants are moving out this weekend, and he needs to get rid of this property asap.

Of course, you never know what can happen. I guess I will just have to wait and see.
